HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.40874 OF 2017 ORDER:

The grievance of the petitioner is that his vehicle and stocks were seized on 07-09-2017 and the petitioner challenged the said seizure in WP.No.36673 of 2017 and the same was disposed of by this Court granting liberty to the petitioner to approach the 2nd respondent-Joint Collector. The petitioner made application on 14-11-2017 for release of the vehicle as well as stocks. As no orders are passed, the present writ petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government for Civil Supplies.

Since it is stated that the application is pending before the 2nd respondent, the 2nd respondent is directed to consider the application of the petitioner for release of the vehicle as well as stocks on furnishing security to the satisfaction of the 2nd respondent within a period of two weeks from the date of receipt of a copy of this order. Till application is disposed of, the seized stocks shall not be sold. It is stated that though learned Magistrate directed the vehicle to be produced before the 2nd respondent, as on today, the 3rd respondent has not produced. In view of the same, the 3rd respondent is directed to produce the vehicle before the 2nd respondent if not already produced.

With the above direction, the writ petition is disposed of.
