HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.47047 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents more particularly the second respondent in granting compound wall permit order vide permit No.3/ C19/ 17493/ 2018 dated 09.11.2018 to the third respondent without verifying the property physically and without considering the fact that the compound wall is already built by the third respondent about 30 years back itself and thereby permitting the third respondent to demolish the compound wall of the petitioners' property without considering the representation of the petitioners and without issuing any notice to the petitioners, as arbitrary and illegal. 2) The grievance of the petitioner appears to be that though he made a representation on 14.12.2018 till date the same is not considered and trying to remove the compound wall of the petitioners.

3) Sri L.Venkateswara Rao, learned Standing Counsel appearing for the second respondent would submit that if the said application is still pending consideration, the authorities may be directed to consider the said representation in accordance with law.

4) Without going into the merits of the case and having regard to the facts and circumstances of the case, the present writ petition is disposed of, directing the second respondent to dispose of the representation dated 14.12.2018, in accordance with law, as expeditiously as possible, preferably within a period of two (02) weeks from the date of receipt of the order, if the same is made and still pending consideration, after hearing all the concerned. Till such time no coercive steps for removal of compound wall shall not be taken. No order as to costs.

5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
