Smt. Chuppa Nirmala v. The State Of Telangana,

2018-12-31A.Rajasheker Reddy1 pages

HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.47169 of 2018 ORDER:

The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble court may be pleased to issue an appropriate Writ, Order, or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent in not taking any action in pursuance of the representation of the petitioner dated 16.11.2018 not to mutate the name of the 5th respondent in the revenue records in Survey No.41/E to an extent of Acs.4.39 guntas of Kukkunda Village, Daroor Mandal, Vikarabad District, as being illegal and arbitrary and consequently, to direct the 2nd respondent to consider and dispose of the aforesaid representation and to pass such other order or orders as this Court may deems fit and proper."

Perusal of the aforestated prayer shows that the Writ Petition was filed on a mere apprehension and the cause of action has not even arisen as on date. The Writ Petition is therefore utterly premature and is accordingly dismissed. This order shall however not preclude the petitioner from seeking appropriate remedies in accordance with law as and when the cause of action does arise. Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
