D. Noor Mohammed, v. The State Of Andhra Pradesh,
Between:
D.Noor Mohammed, s/o. D.SilarSaheb, Aged 45 years, Occu: Advocate, Door No.8/42, Gooty, Ananthapuramu District and another.
.....Petitioners and The State of Andhra Pradesh, rep.by its Prl.Secretary, Cooperative Societies Department, Velagapudi, Amaravathi, Guntur district and others.
.....Respondents The Court made the following:
ORDER:
Petitioners were Members of the Gooty Cooperative Town Bank Limited. By resolution of the Board of Directors dated 27.03.2016, names of petitioners were removed as Members from the voters list of the said Bank. Petitioners are aggrieved by the election notification issued on 14.12.2018. Petitioners contend that it is illegal to exclude their names from the voters list. Even according to material placed on record by the petitioners, particularly the letter dated 07.12.2018 given by the Bank, it is clear that petitioners are no more members of the Bank and, therefore, question of including the names of petitioners in the voters list does not arise. The decision of the Bank to remove the petitioners from the membership of the society is not under challenge. Further more, election process is already set in motion. Once selection process is set in motion, ordinarily Court should not interfere in conducting elections.
2.
Having regard to the same, leaving it open to petitioners to work out their remedies against removal of their names from the membership of the Bank as well as conducting of elections, in accordance with law, Writ Petition is dismissed. Pending miscellaneous petitions shall stand closed.
