THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO TRANSFER CIVIL MISCELLANEOUS PETITION Nos.841 and 842 of 2017 COMMON ORDER :

These petitions are filed by the petitioner/ husband, seeking transfer of F.C.M.C.No.24 of and F.C.M.O.P.No.42 of 2017 on the file of the Family Court, Srikakulam to the Family Court, Vizianagaram. Heard both sides and perused the material on record. It is stated by the petitioner that the petitioner herein, who is petitioner in F.C.M.O.P. filed for restitution of conjugal rights and respondent in F.C.M.C. is working as Junior Assistant in the Judicial First Class Magistrate, Srikakulam and the said Court and the Family Court are situated in the same compound.

Having regard to the above, to avoid unpleasantness and to sub-serve the ends of justice, both the matters are withdrawn from the file of the Family Court, Srikakulam and transferred to the file of Judicial First Class Magistrate and Senior Civil Judge, Rajam respectively.

Accordingly, both the Tr.C.M.Ps. are allowed. The petitioner/ husband herein has to pay Rs.200/ - (Rupees Two hundred only) to the wife towards transport charges, whenever she attends the Court at Rajam in F.C.M.O.P.No.42 of 2017. The personal appearance of the petitioner herein shall be dispensed with in F.C.M.C.No.24 of 2017, if he represents through advocate.

Consequently, miscellaneous petitions, if any, pending shall stand closed. No costs.
