The Court made the following Order:
This Criminal Petition is filed by the petitioners/A-2 to A-4 under section 438 of Cr.P.C., seeking to enlarge them on bail in anticipation of their arrest in Crime No. 1068 of 2017 of Uppal Police Station, Ranga Reddy district registered for the offences punishable under section 498-A of IPC and Section 3 and 4 of the Dowry Prohibition Act.
2. Heard the learned counsel for the petitioners/A-2 to A-4 and the learned Public Prosecutor for the respondent/State.
3. According to the case of prosecution, on 29/04/2015 the defacto complainant married A-1 as per Hindu customs and traditions. At the time of marriage, her parents gave Rs.5 lakhs and ten tulas of gold to A-1. Before marriage, A-1 told that he is a software employee working in Bengaluru but after the marriage, the defacto complainant found that A-1 had no employment.
4. The petitioners herein, who are A-2 to A-4, are parents in-law and brother-in-law of the defacto complainant. The allegations against them, as can be seen from the complaint, are omnibus in nature, while specific allegations are attributed only against her husband, who is arrayed as A-1 in the above crime. Hence, considering the facts and circumstances, this Criminal Petition is allowed.
5. Accordingly, the petitioners/A-2 to A-4 shall be released on bail in the event of their arrest in Crime No. 1068 of 2017 of Uppal Police Station, Ranga Reddy district, on their executing a personal bond of Rs. 10,000=00 (Rs. Ten Thousand only) with two sureties for the like sum each to the satisfaction of Station House Officer, Uppal Police Station, Ranga Reddy district.
6. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed.
