HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.47404 OF 2018 ORDER:

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondent authorities in threatening to demolish the structures in premises bearing D.No.1145, situated at Anakapalli Chinna Veedhi, Visakhapatnam District, under the pretext of road widening without issuing any notice and without following the procedure contemplated under the Statute as being illegal arbitrary unjust and unconstitutional.

Heard learned counsel for the petitioners and the learned Standing Counsel for respondent Nos.2 and 3.

Learned counsel for the petitioners would submit that the respondents are trying to demolish the structures while widening the road, without following due process of law. Learned Standing Counsel would contend that so far the proposal of widening road has not yet done and if any action is to be initiated, the same shall be in accordance with law. Recording the same, the writ petition is disposed of directing the authorities not to take any coercive steps in respect of the subject property, except in accordance with law. If any consent is given, the authorities may proceed in accordance with law.
