THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.43233 of 2017 ORDER:

The petitioner was selected as a Field Assistant and was appointed as such in respect of Iddanavalasa Gram Panchayat, Mentada Mandal, Vizianagaram District. While he was continuing as such, he met with an accident on 06.12.2015 and sustained grievous injuries. He was admitted in the hospital and underwent surgery. He applied for three months leave. But, the third respondent granted leave for two months with salary and one month without salary by his proceedings dated 12.02.2016. Immediately after recovery, he submitted his joining report on 05.07.2016. While so, the fourth respondent addressed a letter on 21.08.2016 to the third respondent informing about the petitioner joining the duty and sought clarification for payment of salary and further course of action.

When the third respondent did not pass any order, the petitioner submitted a representation on 05.06.2017 and the second respondent directed the third respondent to look into the matter. The third respondent issued a letter on 16.09.2017 informing the petitioner that further action would be taken after receiving report from the fourth respondent. When no action was taken by respondent Nos.2 to 4, the present Writ Petition is filed.

When the matter was taken up for consideration on 19.12.2017, it was adjourned for getting instructions, and today

the learned Counsel for the respondents fairly submits that the petitioner would be admitted to duty subject to the production of fitness certificate and he will be allowed to discharge his duties.

In view of the above, recording the submission of the learned Counsel for the respondents, this Writ Petition is disposed of directing respondent Nos.3 and 4 to permit the petitioner to discharge his duties as Field Assistant forthwith, subject to the production of fitness certificate in that regard. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 03.01.2018 vs
