O R D E R
The grievance of the petitioners is that though this court in the earlier W.P.No.44071 of 2018 filed by them, granted interim order in I.A.No.1 of 2018 dated 06.12.2018, and the same is subsisting, 4th respondent - Tahsildar, without issuing any notice, passed the impugned order in Rc .No.B/ 1889/ 2018 dated 21-12-2018, canceling their names in Online Adangal and IB namuna.
Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue.
Impugned proceedings dated 21-12-2018 does not disclose that petitioners were issued with any notice before canceling their names in the online adangal and IB namuna. This amounts to violation of principles of natural justice, and on this ground alone, impugned proceedings are set aside.
It is made clear that if the respondents / competent authority intend to take action, it is open to them to take appropriate action in accordance with law after issuing notice and opportunity of hearing to the petitioners.
With the above direction, writ petition is disposed of. Interlocutory applications pending, if any, shall stand closed. No costs.
