HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.42658 of 2017 ORDER:
In this writ petition, the grievance of the writ petitioners is that under the guise of widening the existing road from 33 feet to 66 feet, the respondents 1 to 3 are attempting to demolish the properties of the petitioners bearing house nos.2-12/5, 2-196 & 2-201 respectively situate at Ponka village, Mamda Mandal, Nirmal District, without following the due process of law.
Learned counsel for the petitioners would submit that the petitioners are residing in the subject houses since a long time and that they are paying property taxes.
Learned Government Pleader representing the respondents, on instructions, would submit that the respondent authorities are only strengthening the existing road and are not widening the road.
Recording the afore-stated submissions, the Writ Petition is disposed of directing the respondents not to interfere with or demolish any part of the subject properties of the petitioners; and, in the event there is any proposal for road widening, the respondents shall follow due process of law. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
