HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.41932 OF 2017 ORDER:

This Writ Petition is filed seeking to declare the action of respondent Nos.2 and 3 in threatening the petitioner and forcibly dispossessing her from the land including affected portion of RCC building bearing H.Nos.6-3-131/15NR and 6-3-131/17/NR part, situated at Narsapur X Road, Balanagar, Hyderabad, without issuing any notice under the provisions of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for short, 'the Act'), as illegal and arbitrary.

2. At the hearing, it is represented by the learned counsel for parties that in similar circumstances, this Court disposed of W.P.No.36687 of 2017 and batch on 04.12.2017 and this Writ Petition can also be disposed of in terms of the orders passed in the said batch of Writ Petitions.

3. In view of the same, if the petitioner has not consented for acquisition of the property, the respondent authorities have to follow due process of law as envisaged under the provisions of the Act. Only after following the said procedure, the respondent authorities shall demolish and evict the petitioner from the subject property. In case the petitioner gives consent for acquisition, the respondent authorities may proceed further on the basis of consent given by her.

4. With the above directions, the Writ Petition is disposed of Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. __________________________ A. RAJASHEKER REDDY, J December 20, 2017 MD
