HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.13931 OF 2018 ORDER:

The petitioners/A2 to A4 in this petition filed under Section 482 Cr.P.C. seek to quash the proceedings against them in C.C.No.446 of 2016 on the file of II Additional Chief Metropolitan Magistrate, Vijayawada, Krishna District, wherein cognizance was taken for the offences under Sections 498-A, 323, 506 IPC r/w Sections 3, 4 and 6 of Dowry Prohibition Act.

Having regard to the fact that C.C. is now coming up for framing of the charges before the trial court, this Court is of the considered view that the case cannot be quashed. However, the petitioners are given liberty to approach the trial court and seek for discharge if they are so advised, in which case, the trial court shall pass an order on merits expeditiously. Having regard to the submission of the learned counsel for petitioners that the petitioners/A2 to A4 are women, of which petitioner No.1/A2 is an old lady, their appearance before the trial court is dispensed with except on the occasions when the trial court requires their attendance. 3.

Accordingly, with the above directions, this criminal petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
