HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.47156 of 2018 ORDER:

This writ petition is filed seeking a Writ of Mandamus, declaring the action of respondents in not implementing G.O.Ms.No.93, dated 31.08.2018 in respect of the petitioners herein for the post of Additional Director of Health Services as recommended by Departmental Promotion Committee (DPC), as bad, arbitrary and contrary to G.O.Ms.No.93, dated 31.08.2018.

Heard Sri T.S.V.Prasad, counsel for petitioners and the Government Pleader for Services-II, appearing for respondents. It has been contended by the petitioners that they were promoted as Additional Directors of Medical and Health Services vide G.O.Ms.No.93, dated 31.08.2018. The grievance of the petitioners is that though the petitioners were promoted as Additional Directors/Regional Directors of Medical and Health Services, respondents are not issuing posting orders inspite of lapse of more than four months. Counsel appearing for petitioners contend that appropriate orders be passed directing the respondents to give posting orders in accordance with G.O.Ms.No.93, dated 31.08.2018.

Learned Government Pleader for Services-II submits that appropriate posting orders would be issued to the petitioners in accordance with Rules, within reasonable period of time. This Court, having considered the rival submissions of the parties, is of the considered view that this writ petition can be disposed of directing the respondents to give posting orders to the petitioners in terms

of their promotion to the post of Additional Directors/Regional Directors of Medical and Health Services vide G.O.Ms.No.93, dated 31.08.2018 within a period of eight weeks from the date of receipt of a copy of this order.

With these observations, the writ petition is disposed of. No order as to costs.
