HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.40019 OF 2017 O R D E R :

This petition is filed for a writ of Mandamus declaring the inaction of the respondents in considering the petitioner's representation dated 25.01.2016, 17.02.2016, 01.02.2017, 03.04.2017, 18.07.2017 and 23.09.2017, respectively for removal of the encroachments in panchayat land i.e. 'Rastha' in R.S.No.665, admeasuring 0.66 cents, situated in Brahmadevam Village, Muthukuru Mandal, SPSR Nellore District, as per the provisions of the A.P.Panchayat Raj Act, 1994, as illegal and arbitrary and for a consequential direction to the respondents to remove the encroachments.

Heard learned counsel for the petitioner.

Sri G.Seshadri, learned Standing Counsel for respondents 3 and 4 submits that already survey was conducted and as soon as they receive the report, action will be initiated. In view of the above, the writ petition is disposed of directing the respondents to consider the representation of the petitioner within a period of three months from the date of receipt of a copy of this order and take action in accordance with law. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
