ADDL. PUBLIC PROSECUTOR (TS) The Court made the following ORDER:
"This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioners/accused Nos.1, 2, 6 to 10 for grant of bail in Crime No.903 of 2017 on the file of the Malkajgiri Police Station, Rachakonda Commissionerate, registered for the offences punishable under Sections 342, 370, 153(A)(c) and 120-B of I.P.C., Section 3(2)(v) of SCs & STs (POA) Amendment Act, 2015, and Section 42 of the Juvenile Justice Act, 2015.
2. Heard the learned counsel for the petitioners/accused Nos.1, 2, 6 to 10, learned Additional Public Prosecutor representing the respondent-State and perused the record.
3. The specific allegation against the petitioners/accused Nos.1, 2, 6 to 10 is that they have brought children from the nearby areas and making them to study Urdu and Quran and also few other religious books written in Arabic, without there being
proper registration and permission from the concerned authorities. Accused Nos.3, 4 and 5 in this crime were granted bail by the learned Special Sessions Judge for trial of cases under SCs & STs (POA) Act - cum - VII Additional District & Sessions Judge, Ranga Reddy District at L.B.Nagar, vide orders, dated 05.12.2017, passed in Crl.M.P.Nos.346/2017, 366/2017 and of respectively.
The petitioners/accused Nos.1, 2, 6 to 10 were remanded to judicial custody on 18.11.2017. All the material witnesses are examined. Major part of the investigation is completed. The violations on the part of the petitioners/accused Nos.1, 2, 6 to 10 are required to be established after due trial. Having regard to the nature of allegations levelled against the petitioners/accused Nos.1, 2, 6 to 10, they can be enlarged on bail under Section 439 of Cr.P.C. on some conditions.
4. Accordingly, the petitioners/accused Nos.1, 2, 6 to 10 are ordered to be released on bail on their executing personal bonds for a sum of Rs.10,000/- (Rupees ten thousand only) each with two sureties in a like sum each to the satisfaction of the learned X Metropolitan Magistrate, Cyberabad at Malkajgiri. On such release, the petitioners/accused Nos.1, 2, 6 to 10 shall report before the Station House Officer, Malkajgiri Police Station, Rachakonda Commissionerate, on every Saturday and Sunday between 08:00 AM and 09:00 AM, till filing of the charge-sheet.
5. The Criminal Petition is, accordingly, allowed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed."
