The grievance of the petitioner is that without any prior notice, straightaway impugned notice was issued directing the petitioner to remove the structures, otherwise action will be taken for removing the same.

Learned Standing Counsel for respondents 2 and 3 submits that the impugned notice can be treated as show-cause notice and the petitioner can file explanation. In view of the same, the writ petition is disposed of giving liberty to the petitioner to file explanation to the impugned notice dated 08-12-2017 within a period of four weeks from today. On filing of such explanation, the 3rd respondent shall consider the same and pass orders after giving opportunity of hearing to the petitioner. Till passing of said orders, there shall be stay of demolition of the house constructed in re-survey No.212/1, Chintalapeta, Gudavali Village, Grampanchayat, Vijayawada Rural, Krishna District to an extent of 290.4 square yards.
