HON'BLE SRI JUSTICE S.V.BHATT W.P.No.40016 of 2017 O R D E R:- Heard Mr K.V.Bhanu Prasad, counsel for petitioner and the Assistant Government Pleader Home for respondents.

The petitioner prays for the following relief: ".....writ of mandamus declaring the action of 2nd respondent not disposing of the representation dated 15.11.2017 submitted by the petitioner vide Petition ID.No.151117/00905 as deliberate, abdication of duties, illegal, arbitrary, malafide, intentional and consequently direct the respondent to dispose of the representation dated 15.11.2017 as expeditiously as possible in the interest of justice............."

Mr Bhanu Prasad contends that a few grievances are perceived by petitioner against 3rd respondent and these grievances have been brought to the notice of 2nd respondent through representation dated 15.11.2017. The petitioner is satisfied, if this Court satisfies considers directing 2nd respondent to dispose of the representation. The Assistant Government Pleader Home on instructions submits that a case and counter case are registered and on account of non-availability of petitioner, the FIR could not be served.

Be that as it may. The grievance is not that whether FIR could be served on petitioner or not but the manner it

is alleged as to how the petitioner was treated by 3rd respondent. I am satisfied, to meet the ends of justice the writ petition can be disposed of by this order. "The 2nd respondent considers and disposes of representation dated 15.11.2017 as expeditiously as possible preferably within two (02) weeks from the date of receipt of copy of this order and communicates his decision to petitioner. There shall be no order as to costs."
