Assailing the notice issued by the 4th respondent - Kaikaluru Gram Panchayat, represented by its Panchayat Secretary, vide Rc.No.BLR61/ A/ 2014-15 dated 24.01.2017, to remove the deviations in the building, the petitioner filed appeal before the 3rd respondent - District Panchayat Officer, under Section 128(1) of the Panchayat Raj Act on 22.02.2017. Now the grievance of the petitioner is that the 3rd respondent has not passed any orders and despite the pendency of his appeal, the 4th respondent, is trying to demolish the structures. Hence the writ petition. Heard the learned counsel for the petitioner and the Standing Counsel for respondents 4 and 5 - Gram Panchayat and the perused the material on record.
Having regard to the facts and circumstances and the submissions of the learned counsel, without expressing any opinion on merits, the writ petition is disposed of directing the 3rd respondent to dispose of the appeal filed by the petitioner on 22.02.2017, in accordance with law, as expeditiously as possible. Till the disposal of the appeal, notice issued by the 4th respondent dated 24.01.2017, shall remained stayed. Miscellaneous petitions pending if any, shall stand closed. No order as to costs.
