HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.47178 of 2018 ORDER:
The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble court may be pleased to issue an appropriate Writ, Order, or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not issuing pattadar pass book and title deed to the petitioner in land bearing Survey No.111 to an extent of Ac.1.26 guntas situated at Bahadurpet Village, Alair Mandal, Yadagiri-Bhongir District as illegal, arbitrary, violative of rights guaranteed by the Constitution of India and to pass such other order or orders as this Hon'ble Court deems fit, just and proper in the circumstances of the case."
It is however admitted by Sri Ch. Venkat Raman, learned counsel, that the petitioner has not made an application for grant of pattadar pass book in accordance with the due procedure prescribed under the Telangana Rights in Land and Pattadar Pass Books Act, 1971.
The Writ Petition is accordingly disposed of permitting the petitioner to make a proper application in accordance with the prescribed procedure. As and when such an application is filed, respondent No.4 shall consider the same as per law. Pending Miscellaneous Petitions, if any, shall stand closed in the light of this final order.
