THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE SRI JUSTICE M.GANGA RAO WRIT APPEAL No. 1829 OF 2017 JUDGMENT: (Per VRS,J) Aggrieved by the refusal of the learned Judge to grant interim stay of a notification for recruitment, the writ petitioner before the learned Single Judge has come up with the above writ appeal. 2.

Heard Mr.Sama Sandeep Reddy, learned counsel for the appellant.

Challenging a notification for recruitment of Assistant Professors dated 12.09.2017, the appellant filed a writ petition. Pending writ petition, the appellant sought interim stay of the recruitment process.

While ordering notice in the writ petition, the learned Judge passed an order to the following effect:

"Let the process of selection go on, but the result would be subject to further orders in the Writ Petition." 5.

Contending that the learned Judge ought to have granted stay of the recruitment process, the petitioner has come up with the above writ appeal.

It is seen from the notification under challenge before the learned Single Judge that 274 vacancies have been notified. No recruitment process of this nature can be put on hold, merely on the ground of existence of a prima facie case. The one and only interim order that could be passed whenever a recruitment, promotion or seniority is questioned, is to say that anything done during the pendency of the writ petition will be subject to further orders and this is what the learned Judge has done and hence there is no reason to interfere with the said order.

Therefore, the Writ Appeal is dismissed. No order as to costs. Consequently, miscellaneous petitions if any pending in the writ appeal shall stand closed.
