Respondent/Complainant Petition under Sections 437 & 439 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to grant Regular Bail to the petitioner/Accused No.3 in NDPS SC.No. 117 of 2017 pending on the file of the Hon'ble I Additional District and Sessions Judge, East Godavari at Rajamahendravaram. The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri Ch.Dhanamjaya, Advocate for the Petitioner and of Addl. Public Prosecutor (AP) for the Respondent, the Court made the following ORDER:
" This Criminal Petition is filed by the petitioner/A.3 under Section 439 of Cr.P.C. for grant of bail to him in Crime No.27 of 2017 of Rajamahendravaram Urban Police Station, East Godavari District, registered for the offence punishable under Section 8(c) r/w 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Heard the learned counsel for the petitioner/A.3, learned Additional Public Prosecutor representing the respondent-State and perused the record. 3.
The learned counsel for the petitioner/A.3 would fairly concede that the alleged seizure is a commercial quantity and contended that the petitioner/A.3 is suffering from AIDS and he has filed the copies of medical certificates to show the same. There is no dispute with regard to the petitioner/A.3 suffering from AIDS. 4.
As seen from the entire material on record, there is a prima facie case against the petitioner/A.3. It is not a fit case to grant bail to the petitioner/A.3 as prayed for in this application. However, in view of his suffering from AIDS, he has to take some treatment. So, the petitioner/A.3 can be granted interim bail for a period of 30 days, commencing from 6th January, 2018 to 4th February, 2018. 5.
Accordingly, the petitioner/A.3 is ordered to be released on interim bail for a period of 30 days i.e. from 06.01.2018 to 04.02.2018 (both day inclusive), on his executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties in a like sum each to the satisfaction of the learned I Additional Sessions Judge, Rajamahendravaram, East Godavari District. Both the sureties shall be the relatives and owning immovable properties in the native village of the petitioner/A.3. On release, the petitioner/A.3 shall report before the Station House Officer, Rajamahendravaram Urban Police Station, East Godavari District, on every Sunday between 9.00 a.m. to 10.00 a.m., till expiry of the interim bail. On expiry of the interim bail, the petitioner/A.3 shall surrender before the Superintendent, Central Jail, Rajamahendravaram, East Godavari District on 05.01.2018 by 11.00 a.m.
