This writ petition is filed to declare the action of the 3rd respondent in not complying the order dated 07-11-2017 passed by the 2nd respondent in restoring the authorization of petitioner's fair price shop as illegal and arbitrary. It is the case of the petitioner that when respondentofficials inspected the fair price shop of the petitioner on 07-01-2016 found that there are (-) quintals 9.78kgs of rice issued to the cardholders without obtaining their signatures in sales register and thereafter, a case under Section 6-A of the Essential Commodities Act was registered and the authorization of the petitioner's fair price shop was suspended. During the course of enquiry, the joint Collector has imposed penalty of Rs.
3,123/- and the petitioner has paid the same and in pursuance to the same, the Revenue Divisional Officer issued proceedings dated 07-11-2017 restoring the authorization of the petitioner's fair price shop with immediate effect. It is also the case of the petitioner that the petitioner has paid the amounts for supplying the stocks. Learned Government Pleader for Civil Supplies produced written instructions stating that the petitioner has not remitted the challan for renewal of his authorization. Learned counsel for the petitioner says that by 15-12-2017 amount for renewal of authorization also been paid.
In view of the above, the writ petition is disposed of directing the respondent-authorities to restore the petitioner's fair price shop authorization, since it is stated that the petitioner has paid the amounts and thereafter take action for supplying stocks in pursuance proceedings dated 17-11-2017. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 27-12-2017 Nvl
