This Criminal Petition is filed under Section 438 Cr.P.C. seeking to grant anticipatory bail to the petitioner-A.1 in C.C. No.1200 of 2008 on the file of the VI Additional Judicial Magistrate of First Class, Rajamahendravaram, for the offences punishable under Sections 403, 406, 420 read with 34 IPC.

Heard the learned counsel for the petitioner-A.1, the learned Additional Public Prosecutor and perused the material available on record.

As per the material placed on record, the present crime No.77 was registered in the year 1998 by the II Town L&O police station, Rajahmundry. Thereafter, charge sheet was filed and the crime was numbered as C.C. No.1200 of 2008 on the file of the VI Additional Judicial Magistrate of First Clafss, Rajamahendravaram. Learned counsel for the petitioner-A.1 would submit that the petitioner has no knowledge about issue of the F.I.R. and filing of the charge sheet in this case. There is record to show that a Nonbailable Warrant was issued by the Court below against the petitioner-A.1 and its execution is pending for a long time. The allegations are grave against the petitioner-A.1.

Therefore, it cannot be held that he is innocent person. There are no mitigating circumstances to allow this application. The petitioner is directed to surrender before the court concerned and seek regular bail.

With the above observation, the Criminal Petition is dismissed.
