HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.13962 OF 2018 ORDER:

The petitioners/A2 and A3 seek to quash the proceedings against them in C.C.No.208 of 2018 on the file of Additional Junior Civil Judge, Badvel, wherein cognizance was taken for the offences under Sections 498-A r/w 34 IPC and Sections 3 and 4 of Dowry Prohibition Act against the petitioners and A1.

Having regard to the fact that charge sheet is already filed and the matter is coming up for framing of charges before the trial court, this Court is not inclined to quash the proceedings. If the petitioners are so advised, they may seek for their discharge by appearing before the trial court and putting forth the defence pleas that are legally permissible, in which case, the trial court shall pass an order on merits expeditiously. Having regard to the request of the learned counsel for petitioners and also considering that the petitioners A2 and A3 are aged persons, their appearance before the trial court is dispensed with except on the occasions when the trial court specifically requires their attendance.

Accordingly, with the above directions, this criminal petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
