.....Respondent Petition under Section 438 of Cr.P.C praying that in the circumstances stated in the memorandum of grounds filed herein the High Court may be pleased to grant anticipatory bail to the petitioner/accused No.2 in the event of his arrest in Crime No. 324 of 2013, Nagarampalem Police Station, Guntur Urban, Guntur District.

The petition coming on for hearing, upon perusing the Petition and the memorandam of grounds filed in support thereof and upon hearing the arguments of SRI.K.RAMAMOHAN, Advocate for the Petitioner and Additional Public Prosecutor (AP) for Respondent, the Court made the following.

ORDER:

This petition is filed under Section 438 Cr.P.C. to grant anticipatory bail to the petitioner-A2 for the offence alleged under Section 306 IPC.

Heard learned counsel for the petitioner-A2, learned Additional Public Prosecutor representing the State and perused the record.

In the course of submissions made by both sides, it has come to light that the petitioner-A2 is the father of A1 in this case. There was alleged sexual harassment by A1 to the deceased-Chitti Seetha Maha Lakshmi. A1 along with his friends said to have forced the deceased to indulge in prostitution. Thereafter, one Siva Naga Raju developed illegal intimacy with the deceased

and the same has been figuring in the F.I.R. lodged in this case. In the suicidal notice, it has come to light that A1, his father and others are responsible for the commission of suicide by the deceased in this case.

Having regard to the nature of allegations levelled against the petitioner-A2 and the material collected so far, the petitioner-A2 can be granted bail under Section 438 Cr.P.C.

In the result, the Criminal Petition is allowed directing the petitioner-A2 to surrender before the Station House Officer, Nagarampalem Police Station, Guntur Urban District, within 15 days from the date of this order. On such surrender, the said S.H.O. shall release the petitioner-A2 on bail, on his executing a personal bond for Rs.10,000/- (Rupees ten thousand only) with two sureties each in a like sum to his satisfaction. On release, the petitioner-A2 shall abide by the conditions mentioned under Section 438 (2) Cr.P.C. The petitioner-A2 shall attend before the S.H.O., concerned on every Sunday between 10.00 A.M. and 11.00 A.M. till filing of charge sheet.
