The case of the petitioner is that he was a successful bidder in respect of auction conducted on 27-03-2017 to shop No.4 of Sri Thangirala Veera Raghavaiah Shopping Complex, Avanigadda, Krishna District. In pursuance to the same, the petitioner has paid the bid amount, but the respondentauthorities are not handing over the possession of the shop. Aggrieved by the same, the present writ petition is filed. Heard learned counsel for the petitioner.
Sri G.Seshadri, learned Standing Counsel for respondentGrampanchayat on instructions submits that the person who is in occupation of said shop filed civil suit against Grampanchayat and stated that no injunction was granted. The Grampanchayat also filed suit for recovery of amount against the said person.
It is to be seen when there is no injunction operating against Grampanchayat, it is not known why the Grampanchayat is not taking action for vacating the person in whose favour, licence expired.
In view of the same, respondent No.5 is directed to take appropriate action for handing over the shop No.4 in respect of which, the petitioner has become successful bidder and paid the amount, within a period of two weeks from the date of receipt of a copy of this order.
With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 14-12-2017 Note:
