HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.47340 of 2018 ORDER:

The prayer of the petitioners in this case reads as under: "For the reasons stated in the affidavit, the petitioners pray that this Hon'ble court may be pleased to issue an appropriate Writ, Order, or Direction, more particularly one in the nature of Writ of Mandamus directing respondent Nos.1 to 4 herein to issue pass books in respect of the petitioners' lands bearing Survey Nos.491, 515 and 519 (as per the details of extents shown at para-7 of the writ affidavit) situated at Maddigatla Village, Bhoothpur Mandal, Mahabubnagar District, under the new scheme and pay the amounts payable to the petitioners herein under the Rythu Bhandu Scheme and pass such further order or orders as this Hon'ble may deem fit and proper in the circumstances of the case."

It appears that the petitioners along with others made an application on 11.9.2018 to the Tahsildar, Bhoothpur Mandal, Mahabubnagar District, respondent No.4, seeking issuance of revised pattadar pass books.

Though the learned Assistant Government Pleader for Revenue would state that the petitioners may not be entitled to seek issuance of revised pattadar pass books in respect of lands in the survey numbers mentioned by them, it would be premature for this Court to go into the said issue at this point of time. It is for respondent No.4 to consider the application dated 11.9.2018 in so far as it pertains to the petitioners herein on its own merits and in accordance with law. In the event, the petitioners are found to be deserving of issuance of revised pattadar pass books, necessary steps may be taken in that regard. This exercise, one way or the

SK, J WP.No.47340 of 2018 Dated:02.01.2019 other, shall be concluded by respondent No.4 within two months from the date of receipt of a copy of this order. The Writ Petition is disposed of, with the above directions. Pending Miscellaneous Petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTICE SANJAY KUMAR 02nd January, 2019 DR
