THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.40213 OF 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ, order or direction more in the nature of writ of Mandamus declaring the action of the Respondents 3 and 4 in not filing the Charge Sheet in Crime No.8/2015, dated 14-01-2015 of Indukuripet Police Station even after lapse of 2 years as illegal, arbitrary, malafide and violative of Art.14 of the Constitution of India and consequently to direct the respondents 1 and 2 to take immediate steps for effectively prosecuting the accused in Crime No.8/2015 of Indukurpet police station and to moniter progress of the case in the interest of justice."

A counter-affidavit deposed by the Inspector of Police, Nellore Rural Circle, SPSR Nellore District is filed. At paragraph No.5 of the said affidavit, it is stated that after assumption of charge by the deponent, he expedited the investigation and filed charge sheet on 27.07.2017, which is now pending vide PRC No.32/2017. 3.

In view of the above, nothing further survives for adjudication in this writ petition.

Accordingly, the Writ Petition is closed. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
