The petitioner is stated to be working as Sub Inspector of Police at Atmakur Police Station, Warangal District, and now she is eligible for consideration of her case for promotion to the post of Inspector of Police. She joined the service of the Police Department on 24.12.2010. Departmental proceedings were initiated against her by proceedings dated 20.02.2015 and they are pending. Though initially she was kept under suspension, her suspension was later revoked and now she is working as Sub Inspector of Police at Atmakur, Warangal District. In view of the pendency of the departmental proceedings, when the case of the petitioner was not considered for promotion, she filed the present Writ Petition.

In similar matters, this Court noticed that there is no rule prohibiting consideration of the case of the persons like the petitioner for promotion when departmental proceedings are pending, and granted directions to consider their cases. In the circumstances, this Writ Petition is also disposed of directing the respondents to consider the case of the petitioner for promotion along with others, if there is no rule prohibiting consideration of the case of the petitioner in the facts and circumstances of the case and if she is otherwise eligible. However, this will not be construed as a bar for completing the

pending departmental proceedings initiated against the petitioner.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 30.11.2017 vs
