THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.47323 of 2018 ORDER :

The Petitioner has filed this Writ Petition, assailing order dated 12.10.2018, passed by the 5th respondent placing the petitioner under suspension pending enquiry, on the ground that there is misappropriation of funds of the 5th respondent, that a criminal case is also to be registered, and Managing Committee of the 5th respondent passed resolution to place the petitioner under suspension pending enquiry.

Though the counsel for the petitioner contended that petitioner could not have been placed under suspension, without enquiry under Section 51 of the Andhra Pradesh Co-operative Societies Act, 1964 being held, I do not agree with the said submissions, since it is an inherent power of the employer to place an employee under suspension pending enquiry, when serious allegations are levelled against the employee. Therefore, there are no merits in the Writ Petition.

Accordingly, the Writ Petition is dismissed. There shall be no orders as to costs.

As a sequel thereto, Miscellaneous Petitions, if any, pending stand closed.
