The petitioners seek to quash the proceedings in FIR No.391 of 2018, dated 16.12.2018 on the file of Vedayapalem Police Station, SPSR Nellore District which was registered against them for the offence under Sections 323, 506 R/W 34 IPC, 3 (1) (R ), 3 (1) (s) SC/ST POA Act. 2.

Having regard to the nature of accusation made under different sections of law, this Court is of the considered view that investigation shall proceed to its logical end and therefore, the F.I.R. cannot be quashed. However, having regard to the civil nature of the complaint/allegation, the Investigating Officer during the course of investigation shall scrupulously follow the guidelines given by the Apex Court in Arnesh Kumar Vs. State of Bihar1 and also the procedure contemplated under Section 41-A Cr.P.C. The petitioners in return shall cooperate with Investigating Agency for smooth completion of investigation. 3.
