HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 42743 of 2017 Order:

This Writ Petition is filed challenging the action of the respondents in not paying the subsistence allowance pursuant to the suspension of the petitioner from service by order dated 20.02.2017 and also not concluding the departmental proceedings by keeping the petitioner under prolonged suspension, in spite of submission of explanation to the charge memo issued to the petitioner.

Learned Government Pleader, on the basis of instructions, submits that the subsistence allowance is being released and they would conclude the enquiry within a short time.

In view of the same, this Writ Petition is disposed of directing the respondents 3 and 4 to pay the subsistence allowance to the petitioner pursuant to the order of suspension dated 20.02.2017 and complete the enquiry as expeditiously as possible, but not later than three months from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
