Heard learned counsel for petitioner-Accused No.2. In the interest of justice, the criminal petition is allowed setting aside the impugned order in Crl.MP No.2536 of 2018in CC No.61of 2016 passed by VII Special Magistrate, Erramanzil, Hyderabad. The petitioner/Accused No.2 is directed to appear before the trial Court on or before 22-01-2019 and move a fresh application under Section 70(2) Cr.P.C. in which case, the trial Court shall allow the said petition on suitable terms.
