O R D E R

This writ petition is for a writ of mandamus to declare the action of the 3rd respondent - District Collector, Visakhapatnam District, Visakhapatnam, in including the subject land in an extent of Ac.0.26 cets. In Sy.No.123/ 4 of Chinamushidivada village, Pendurthimandal, Visakhapatnam District, which was granted to the petitioner on payment of market value, in the prohibitory list under section 22(A)(1)(a) of the Registration Act, 1908, vide Rc.No.3795/ 2017/ E1 dated 27-05-2017, as illegal and arbitrary and consequently to direct the 3rd respondent to delete the subject land from the prohibitory list. Learned counsel for the petitioner submits that this court in identical set of facts and circumstances in W.P.No.46074 of 2018 dated 21.12.2018 allowed the writ petition and set aside the proceedings of the 3rd respondent in including the subject land therein, which was allotted on payment of market value, from the list of prohibitory list under Section 22-A (1)(a) of the Act. He submits that the present writ petition may also be disposed of in terms of the said order.

Learned Assistant Government Pleader does not dispute the same. In view of the same and for the reasons alike, present writ petition is allowed and the proceedings of the 3rd respondent vide Rc.No.3795/ 2017/ E1 dated 27-05-2017 are set aside. Office to annex copy of the order dated 21-12-2018 in W.P.No.46074 of 2018 along with this order.

Interlocutory applications pending, if any, shall stand closed. No costs.
