THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 2767 of 2017 ORDER:
This Contempt Case is filed alleging non-implementation of the order dated 27.02.2017 passed by this Court in Writ Petition No. 6624 of 2017.
By the aforesaid order, this Court directed the respondents to take appropriate action pursuant to the letter dated 23.01.2015 for payment of amount due to the petitioner within a period of three months from the date of receipt of a copy of that order. Now, it is brought to the notice of this Court that after examination of the records, the respondents found that only a sum of Rs.19.41 lakhs is due and payable, but not Rs.34.00 lakhs and the said amount has already been paid to the petitioner. In those circumstances, though the learned counsel for the petitioner vehemently asserts that by the aforesaid order, this Court directed the respondents with respect to implementation of the letter dated 23.01.2015, this Court can take note of the fact that the Writ Petition came to be disposed of at the admission stage, without expressing any opinion on the facts of the matter, and it is for the respondents to decide how much amount is due and payable to the petitioner based on the facts.
CKR, J C.C.No.2767 of 2017 In those circumstances, this Court does not find any contempt, much less, criminal contempt, on the part of the respondents in paying the lesser amount than what has been claimed by the petitioner.
Accordingly, this Contempt Case is closed.
