It is the case of the petitioner that an extent of Ac.0.72 cents in Survey No.341/2, situated at Kollagunta Village, Karveti Nagaram, Chittoor District, was granted on lease to one Sri Ranganayakulu, Ex-Serviceman on 22.08.1973 and the same was extended from time to time. He in turn entered into a lease with the petitioner on 24.02.1992 for a period of 99 years. The petitioner thereafter, developed the land by spending substantial amounts for cultivation and continuing to cultivate the same by raising different crops. Now, there is a sugar cane in the said land. While so, the fourth respondent is instigating respondents 2 and 3 to evict the petitioner from the said property and the third respondent with the staff of second respondent came to the subject property on 11.11.2017 and threatened to evict the petitioner. In those circumstances, the present Writ Petition is filed. 2.

Even after issuing Notice before admission on 02.01.2018, no counter-affidavit is filed by any of the respondents. 3.

In the above circumstances, if the petitioner is in possession of the subject property and if the respondents want to take any action against the petitioner, an appropriate notice should be given to the petitioner before taking action.

The Writ Petition is, accordingly, disposed of directing the respondents not to interfere with the possession of land of the petitioner, without following due process of law.
