M. Yadaiah, S/O Late Kondaiah v. The Appellate Committee For Building Regularization Scheme

HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.40891 of 2017 ORDER:

This writ petition is filed seeking the following relief: "..to issue a writ, order or direction more particularly writ of mandamus declaring the action of Respondent No.1 in not disposing the appeals pending on its file in File No.TP/UC/I/CIRXI/WZ/GHMC/2013 filed by Respondent Nos.4 to 8 as against rejection of their application for regularization of structures in respect of Plot Nos.183 to 185, 202 to 204 and 427 & 428 in Sy.No.51 situated at Gachibowli Village, Serilingampally Mandal, Ranga Reddy District as being illegal, arbitrary, contrary to Law and violative of Articles 14 & 21 of the Constitution of India, consequently direct Respondent No.1 to forthwith dispose of the above appeal pending on its file and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

At the hearing, it is brought to the notice of this Court that by proceedings in Memo No.6319/Plg.II(1)/2016, dated 27.12.2017, the Secretary to Government, Municipal Administration and Urban Development Department had already disposed of the Appeal Petition of the petitioner and therefore, no cause survives for adjudication in this writ petition. 3.

Recording the above submission, the Writ Petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
