HON'BLE SRI JUSTICE SURESH KUMAR KAIT CONTEMPT CASE No.2618 of 2017 ORDER : (ORAL) Vide the present petition, petitioners seek directions thereby to initiate proceedings under Contempt of Courts Act against the respondents for deliberate violation of orders dated 27.08.2016, passed by this Court in W.P.No.4217 of 2016.

Learned counsel appearing on behalf of respondents, on advance notice, submits, the land of the petitioners undisputedly falls under D-Category. For other categories, the market value was assessed at Rs.1,05,252/- per acre. Since the D-Category lands are entitled for 50% of the market value, the petitioners are entitled to Rs.52,626/- per acre. The amount at that rate has been disbursed in favour of petitioners by RTGS on 28.12.2017.

Learned counsel appearing on behalf of petitioners submits, their land comes under D-Category and they are entitled to Rs.2,00,000/- per acre, which is not awarded by the respondents. 4.
Keeping in view the submissions made by the learned counsel appearing for the parties, I hereby dispose of the contempt case, granting liberty to the petitioners to challenge the compensation awarded by the respondents and to seek for its enhancement, before appropriate forum. ________________________ SURESH KUMAR KAIT, J 29th December, 2017 ajr
