The case of the petitioner is that the 3rd respondent issued show cause notice dated 25.10.2017, alleging that he has misappropriated the pachayat funds and also asking the petitioner as to why the cheque drawing power from all the funds cannot be stopped and to submit explanation within one week. But, even before expiry of one week period to submit explanation, the 3rd respondent passed the impugned order dated 31.10.2017 stopping the cheque drawing power of the petitioner. Aggrieved by the same, present writ petition is filed.

Learned counsel for the petitioner submits that even before expiry of one week stipulated period in show cause notice, the 3rd respondent passed the impugned order and that petitioner has already submitted explanation on 16.11.2017 enclosing the copies of the bills, vouchers. Heard learned Assistant Government Pleader for Panchayat Raj.

In view of the aforesaid facts and circumstances, since the impugned order dated 31.10.2017 is passed even before the time specified in show cause notice is expired, the same is set aside and the 3rd respondent is directed to consider the

explanation of the petitioner dated 16.11.2017 and pass final orders within a period of two weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs.
