HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.39643 OF 2017 O R D E R :

The case of the petitioner is that he is a rice miller dealing with the business of selling, purchasing and milling of the paddy and rice; and that there is a scheme wherein the Civil Supplies officials purchase the paddy from the farmers with minimum support price and allot the same to the rice millers and the rice millers shall mill the paddy supplied to it and shall deliver the raw rice with the ratio of 67%. While so, in the earlier occasion when the respondent officials did not allot paddy to the petitioner's rice mill, he approached this Court by filing WP.No.36724/2016 and this Court directed the 2nd respondent to consider petitioner's application if he resubmit the application, and communicate the decision to him within a period of two weeks.

Thereafter, the petitioner approached the respondents 2 & 3 along with representation and requested to allot paddy under custom milling rice scheme. Then the 2nd respondent issued a Memo dated 17.12.2016 stating that they will consider the petitioner's request in coming season. The grievance of the petitioner is that in the present season also the respondent authorities are not allotting the stocks to his mill. Hence he again submitted representation dated 17.11.2017 enclosing the earlier memo issued by the 2nd respondent requesting to allot paddy to his rice mill.

Heard learned counsel for the petitioner.

Learned Government Pleader for Civil Supplies submits that allotment can be only in terms of G.O.Ms.No.21, dated 16.10.2017 and not otherwise.

Since the petitioner made application to the 2nd respondent it is for the 2nd respondent to take a decision on the said application. In view of the same, the 2nd respondent is directed to consider the application of the petitioner dated 17.11.2017, in accordance with relevant rules and G.Os. Accordingly, the writ petition is disposed of. No order as to costs.
