2017-11-27A.Rajasheker Reddy1 pages

THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.NO.39768 OF 2017

O R D E R

This writ petition is filed challenging the proceedings of the 2nd respondent - Joint Collector in Rc.D1.93/2017 dated 18.11.2017, whereunder and whereby the Form - B licence bearing No.73/TPT/2004 issued in favour of the petitioner - filling station, was cancelled with a direction to K.Manoj Kumar Reddy and C.Radha Krishnam Raju, to file fresh application for issuance of licence for conducting the filling station.

Heard Sri C.Raghu, the learned counsel for the petitioner, Government Pleader for Civil supplies for respondents, 1 2 and 5, Sri T.Srinivas learned counsel for 3rd respondent and Sri P.Veera Reddy learned Senior Counsel appearing for Sri K.Murali Krishna, for 4th respondent. It is not disputed that against the impugned order, the petitioner has an alternative remedy of appeal. It is not the case of the petitioner that the impugned order was passed without jurisdiction, or in violation of principles of natural justice. In view of the same, I do not find any reason to entertain the writ petition.

Accordingly, the writ petition is disposed of granting liberty to the petitioner to avail the alternate remedy available under law. No order as to costs.

Miscellaneous petitions pending if any, shall stand closed. ----------------------------------------------- A.RAJASHEKER REDDY,J DATE:27-11-2017 avs
