HON'BLE SRI JUSTI CE SANJAY KUMAR AND HON'BLE Ms. JUSTI CE J. UMA DEVI WRI T PETI TI ON No. 41037 of 2017 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The challenge in this writ petition is to the action of the Indian Bank in proposing to put the secured asset belonging to the petitioner to sale on 27.12.2017 pursuant to the sale notice dated 06.11.2017. The last date fixed for receipt of bids from the intending purchasers was 26.12.2017.

Sri Ambadipudi Satyanarayana, learned counsel for the Indian Bank, would inform this Court that no bids were received by the end of the prescribed time on 26.12.2017.

In that view of the matter, the sale proposed to be held today fails for want of bidders and in consequence, the challenge to the sale notice dated 06.11.2017 is rendered purely academic. This Court therefore does not propose to adjudicate the matter on merits. The writ petition is therefore dismissed on this short ground leaving all issues open.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
