This writ petition is filed challenging the provisional assessment notice dated 22-09-2017.
Learned counsel for the petitioner disputes the said liability and says that there is no fault of the petitioner. Until the same is decided by the Special Court under Section 154(6) of the Electricity Act ("the Act"), the petitioner cannot be asked to the amounts.
Heard Sri R.Vinod Reddy, learned Standing Counsel for the respondents.
Pending determination of the amount by the appropriate Court under Section 154(6) of the Act, let the electricity connection of the petitioner be restored on condition of payment of 50% of the demanded amount.
With the above direction, the writ petition is disposed of. However, this order will not preclude the Special Court from determining the liability in accordance with Section 154(6) of the Act.
