O R D E R

The grievance of the petitioner is that though his stocks were seized by the 3rd respondent on 16.11.2017 without heeding to his explanation that he has already applied for change of storage point in his licence and that when he approached the 2nd respondent, the said authority is not entertaining his application. Hence the writ petition.

The learned Assistant Government Pleader for Agriculture, on instructions, submits that report under Section 6-A of the Essential Commodities Act, 1955 has already been filed before the 2nd respondent. In view of the above, it is open for the petitioner to file application before the 2nd respondent ventilating his grievance within a period of one week from today and within two weeks thereafter, the 2nd respondent is directed to dispose of the said application in accordance with law. Till then, the seized stocks shall not be sold.

It is made clear that if the petitioner fails to file the application as stated above, it is open for the 2nd respondent to take appropriate action in accordance with law.

Since the report under Section 6-A of the Act read with clause-3 of Seeds Control Order, 1983 is stated to have been filed, the 2nd respondent is directed to complete the enquiry as expeditiously as possible. With the above direction, the writ petition is disposed of. No costs.
