Heard learned counsel for the petitioner and learned Government Pleader for the respondents.
The petitioner was appointed as Anganwadi Helper on 19.11.2015 in Vemuru-2 Anganwadi Centre, Vemuru, Guntur District. While so, the post of Anganwadi Worker fell vacant on 30.06.2017 in the same centre, where the petitioner has been working as Anganwadi Helper. The petitioner passed Intermediate examination and she fulfilled the qualification required for appointment as Anganwadi Worker. She also states that as per the memo dated 05.01.2012, if Anganwadi Worker post is vacant, the case of the Anganwadi Helper who is qualified should be considered for filling up of that vacancy with the approval of the District Collector concerned. She states that in view of the said memo, she submitted a representation on 01.07.2017 to consider her case for appointment as Anganwadi Worker in Vemuru-2 Anganwadi centre and when the same was not considered, she filed the present Writ Petition. Learned Government Pleader, on the basis of instructions, submits that a notification was already issued on 28.08.2017 for filling up of that vacancy, but no appointment took place.
In view of the memo dated 05.01.2012, the petitioner is eligible to be considered for the appointment of Anganwadi Worker since she is qualified.
In the circumstances, this Writ Petition is disposed of directing the respondents 2 to 4 to consider the representations of the petitioner dated 01.07.2017 and 13.11.2017 and pass appropriate orders before finalizing
the selections pursuant to the notification dated 28.08.2017. It is needless to observe that if the petitioner is qualified and eligible to be appointed as Anganwadi Worker, no final selection shall be made and if she is not eligible and qualified to be appointed the respondents can go ahead with the selection, but before going ahead with the selection pursuant to notification dated 28.08.2017 an appropriate order shall be passed in respect of the case of the petitioner. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
