This writ petition is filed challenging the action of the respondent Nos.2 and 5 in including the land to an extent of Ac.4.10 cents in Sy.No.521/2 of Bandameedakamma Palle Revenue Village, Madanapalle Mandal, Chittoor District in the prohibitory lands list vide G.O.Ms.No.215, dated 13.05.2016, issued by the 1st respondent and the consequential action of the respondent No.6 in refusing to entertain the sale deed for registration stating that the said land is included in the prohibitory lands list as Assigned land.

Learned Counsel for the petitioners submits that the subject land is assigned prior to 1954 and that the Government has issued G.O.Ms.No.575, dated 16.11.2018 ordering for deletion of Government lands assigned prior to 1954 from the purview of Section 22-A of the Registration Act, 1908. He further submits that this Court in similar circumstances allowed WP.No.41615/2018, dated 22.11.2018.

Heard learned Assistant Government Pleader for Revenue who does not dispute the same.

In view of reasons stated in WP.No.41615/2018 and in view of G.O.Ms.No.575, dated 16.11.2018 and since it is

admitted that the subject land is assigned prior to 1954, the writ petition is allowed. No order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 31.12.2018 Tk
