THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.48032 of 2018 ORDER:
The grievance of the petitioner is that the Tahsildar, Patancheru Mandal, Sangareddy District, is not mutating his name in the land records in relation to an extent of Ac.1.00 guntas of land in Survey No.357 of Nandigama Village, Patancheru Revenue Mandal, Sangareddy District, pursuant to his application dated 12.07.2018. Perusal of the record reflects that the petitioner is claiming right over the subject land under a registered sale deed. However, he merely made a representation to the Tahsildar without following the due procedure prescribed under the Telangana Rights in Land and Pattadar Passbooks Act, 1971. As per the said enactment, the petitioner has to submit an application in Form VI(A) along with the requisite fee. Without filing a proper application, it is not open to the petitioner to complain of inaction on the part of the authorities.
The writ petition is accordingly disposed of leaving it open to the petitioner to make a proper application as per the prescribed procedure to the Tahsildar, Patancheru Mandal, Sangareddy District. In the event such an application is made, the Tahsildar shall take requisite action thereon in accordance with law expeditiously and in any event, not later than four weeks from the date of its receipt.
