THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 47924 of 2018 ORDER:
This writ petition is filed challenging the action of the respondents in not withdrawing the LOC against the petitioner inspite of the orders passed by the VI Addl.Sessions Judge, Godavarikhani, dt.02.04.2018, in Crl.R.P.No.3/2018, directing the trial Court to return the passport to the petitioner after obtaining a bond from the petitioner.
Learned counsel for the petitioner states that the trial Court has already released the passport of the petitioner; that there is no restriction for the petitioner to travel abroad, but in view of the LOC issued against the petitioner, the petitioner is unable to travel abroad. Learned Assistant Government Pleader for Home submits that this Court has already dealt with the similar issue in WP.No.3213 of 2015 holding that the petitioner therein can approach the trial Court where case is pending against him, for withdrawal of the LOC. In view of the aforesaid facts and circumstances, it is open for the petitioner to make necessary application before the trial Court where criminal case is pending against the petitioner, for withdrawal of LOC and on such application being filed, the trial Court shall consider the same and pass orders within a period of two weeks from the date of receipt of a copy of this order.
Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel, miscellaneous petitions, if any, pending shall stand closed. No order as to costs.
