The petitioners challenge the proceedings dated 16-11-2017, wherein the 1st petitioner's application for release of seized stock was rejected on the ground of violations committed by the petitioners and the vehicle of the 2nd petitioner was released on furnishing bank guarantee. Learned counsel for the petitioners says that the 1st petitioner has agreement with the licence holder and as such he gave the vehicle to do business in the petroleum products.

On the other hand, learned Government Pleader for Civil Supplies submits that the petitioner 1st does not have Form-B licence to do the business and vehicle does not have registration as per Form-F under the provisions of A.P. Petroleum Products (Licensing And Regulation of Supplies) Order, 1980. As such, the petitioners have committed the violations contravening the provisions of the Petroleum Products Order, 1980 and the 3rd respondent has rightly considered the said aspect and passed orders. It is to be seen that enquiry under Section 6-A of the Essential Commodities Act (for short "the Act") is still pending and the petitioner can raise all such contentions before the competent authority. As such, the competent authority under the Act is directed to issue notice to the petitioners under

Section 6-A of the Act and conclude the enquiry within a period of three months from the date of receipt of a copy of this order. With the above direction, the writ petition is disposed of.
