THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.43047 of 2017 ORDER :

This writ petition is filed with the following prayer: " ...to issue a Writ, order or direction more particularly one in the nature of writ of mandamus declaring the inaction of the respondents operating the petitioner's bus as moffusil service (City Ordinary) as against the actual allotment as Palle Velugu resulting in huge financial loss to the petitioner and for unjust enrichment of the respondent corporation as illegal, arbitrary, in violation of the agreement terms and conditions and Article 14 and 19(1)(g) of Constitution of India and may pass such other order or orders as may deem fit and proper in the circumstances of the case."

The case of the petitioner is that he was successful bidder for running Palle Velugu bus with the respondents-Corporation and quite contrary to the agreed terms, now the respondents are operating the petitioner's bus as moffusil service, which is causing loss to the petitioner as such he made a representation to the 4th respondent on 15.07.2017 and based on the said representation of the petitioner, the 4th respondent has recommended to the respondents 2 & 3, but so far, no action is taken. Aggrieved by the same, the present writ petition is filed.

Heard the learned counsel for the petitioner and the learned standing counsel for the respondents.

Considering the grievance of the petitioner, the writ petition is disposed of directing the 3rd respondent to consider the representation of the petitioner dated 15.07.2017 by taking into

account the recommendations made by the 4th respondent and take a decision accordingly, within a period of four weeks from the date of receipt of a copy of this order. No costs. Consequently, Miscellaneous Petitions pending, if any, shall stand closed.
